Passengers foot crushed by runaway beverage cart on nightmare flight: lawsuit

A Republic Airways passenger’s foot was crushed by a runaway beverage cart during a terrifying trip from Boston to NYC, the victim claims in a new lawsuit.Dalton Sim was sitting in an aisle seat, his right foot protruding into the aisle as Flight 4286 from Logan International Airport made its descent to JFK Airport in June 2023.As the plane touched down, a beverage car barreled towards him and “slammed into [Sim’s] right foot, crushing it against the left armrest of the seat in front of him,” he said in a Brooklyn Federal Court lawsuit.The out-of-control cart didn’t stop there.“The cart continued its uncontrolled trajectory and struck additional passengers seated in front of [Sim] before flipping over and coming to a stop,” the accuser, 54, said in the lawsuit against Republic, which operated the regional flight on behalf of American Airlines.It’s unclear if anyone else was hurt.
Sim, a music industry exec who lives in Massachusetts and once managed the band Guster, accused flight attendants of failing to make sure the cart was properly secured.The incident left Sim, who is seeking unspecified damages, with “numerous disabling crush fractures and a deep wound that required months of intensive medical treatment,” he claimed in court papers.“We are privileged to seek justice on behalf of Mr.Sim for the life-changing injuries he suffered in an entirely preventable incident caused by the egregious and inexcusable negligence of Republic Airways personnel,” his attorney, Erin Applebaum, said.Republic Airways did not respond to a request for comment.
